One hundred and fifty-four land plots including the land plots located in the area of the Volga River in Kstovo District of Nizhny Novgorod Region were arrested according to appeal of the main military investigations department of the Investigations Committee by the Khamovnichesky district court of Moscow. All of them belong to General Director of Remexstroy Alexander Dorofeev accused of breaching of rules of construction work that resulted in deaths of people and fraud on a very big scale.
ABOUT 150 LAND PLOTS OF THE PERSON ACCUSED OF COLLAPSE OF THE BARRACKS OF THE 242ND TRAINING CENTER OF THE AIRBORNE FORCES WERE ARRESTED
One hundred and fifty-four land plots including the land plots located in the area of the Volga River in Kstovo District of Nizhny Novgorod Region were arrested according to appeal of the main military investigations department of the Investigations Committee by the Khamovnichesky district court of Moscow. All of them belong to General Director of Remexstroy Alexander Dorofeev accused by the main military investigations department of committing of crimes outlined by part 3 of article 216 and part 4 of article 159 of the Criminal Code (breaching of rules of construction work that resulted in deaths of people and fraud on a very big scale).
Investigators presumed that it was repair work done by Remexstroy in 2015 in the 242nd training center of the Airborne Forces in Omsk that resulted in collapse of one of the barracks and deaths of 24 draftees of the Airborne Forces. In the course of investigation seven of the 40 people recognized as victims in the framework of the case (mostly relatives of the dead paratroopers) filed lawsuits against Dorofeev worth 80 million rubles at which they estimated the material and moral damage incurred on them. The district court agreed with the stated claims and arrested the property of the builder.
Having complained to the Moscow city court, Dorofeev pointed out that not only he should be liable for the stated claims but also the customers of the work that turned out to be dangerous according to investigators. Incidentally, employees of the customers are also participants of the criminal case about collapse of the barracks.
Dorofeev and his lawyers also pointed out that “principle of proportion was breached during imposing of arrest,” which meant that “correspondence of the value of the arrested property to the size of the presumed damage was not checked.” In turn, representative of investigators and prosecutor’s office requested recognition of the verdict of the Khamovnichesky court “legal, justified and motivated” and declining of the complaint of accused Dorofeev.
The instance of appeals of the Moscow city court did this. Along with this, the court pointed out that value of the arrested property corresponded to the amount of the damage declared in the framework of the case. Dorofeev was released on parole after a year spent in custody.
Meanwhile, it is known that Dorofeev has legal disputes not only related to this criminal case. Lawsuits worth much bigger amounts were filed against his company to arbitration courts by former clients of Remexstroy. Among them are not only structures of the Defense Ministry and Federal Agency of Special Construction but also the Russian Guard that has inherited objects built with breaches in the Volga Federal District from the Interior Forces of the Interior Ministry.
